La justícia belga suspèn l'euroordre contra Puigdemont i Comín per la seva immunitat Puigdemont i Comín amb l'acreditació d'eurodiputats (ACN)

La justícia belga ha suspès l'euroordre contra Carles Puigdemont i Toni Comín per la seva immunitat en condició d'eurodiputats, segons informa la seva defensa. El jutge que havia de resoldre si els entregava a Espanya, com demana el magistrat del Suprem Pablo Llarena, ho ha decidit arran de la sentència del Tribunal de Luxemburg sobre Oriol Junqueras.

Bèlgica aixeca les mesures cautelars i el dia 13 Puigdemont i Comín podran viatjar al ple d'Estrasburg sense haver de demanar permís al jutge belga.

El Tribunal de Justícia Europeu va reconèixer, a propòsit d'un recurs de Junqueras, que els eurodiputats assoleixen la immunitat en el mateix moment que són escollits.

Puigdemont ha reaccionat a Twitter.

"La justícia belga reconeix la nostra immunitat i decideix suspendre l'euroordre!, Toni Comín. Però ara estem esperant l'alliberament d'Oriol Junqueras, que té la mateixa immunitat que nosaltres. Espanya ha d'actuar com Bèlgica i respectar la llei".

A mig desembre, el jutge va suspendre la decisió a l'espera de saber la decisió del Tribunal de Justícia de la Unió Europea. Ara considera que tenen la immunitat després que rebessin l'acreditació com a eurodiputats.

Està previst que el 13 de gener, quan reprèn l'activitat el Parlament Europeu, Puigdemont i Comín ja participin a l'eurocambra.

Un cop reconeguda la immunitat, ara, si la justícia espanyola vol reclamar-los, haurà de demanar un suplicatori al Parlament Europeu perquè els aixequin la immunitat, un tràmit que es pot allargar entre sis mesos i un any.

Fonts del Suprem asseguren que la decisió de la justícia belga ja l'esperaven després de la sentència de Luxemburg sobre Junqueras.

Belgian court suspends extradition warrant for Puigdemont

Judge says former Catalan president benefits from immunity as MEP.

Belgium will not extradite Carles Puigdemont to Spain after a court suspended a European arrest warrant against the former Catalan president, who faces charges for his role in a failed secessionist push.

The decision comes two weeks after a ruling by the European Court of Justice, which said another former Catalan leader, ex-vice president Oriol Junqueras, who was elected as an MEP in May, should have been allowed to leave jail to take up his seat in Parliament. The court said he should have enjoyed the immunity afforded to MEPs from the moment the EU election results were declared. Junqueras was sentenced in October to 13 years in prison for his role in the 2017 independence push.

Referring to that decision, the tribunal in Brussels ruled Thursday that Junqueras' immunity equally applies to Puigdemont and his former health minister, Antoni Comín, who were also elected as MEPs, news agency Belga reported.

"Belgian justice recognizes our immunity and decides to suspend the arrest and extradition warrant," Puigdemont wrote on Twitter. "But now we are still waiting for the release of Junqueras, who has the same immunity as us. Spain must act in the same way as Belgium has done and respect the law."

Spain in October issued a European arrest warrant for sedition and misuse of public funds against Puigdemont and other Catalan politicians who had fled to Belgium in 2017 after the failed bid to declare Catalan independence. Madrid authorities withdrew a previous arrest warrant after a German judge refused to extradite Puigdemont for the charge of rebellion.

Following the new arrest warrant, Puigdemont in October handed himself in to Belgian authorities, who postponed the decision on potential extradition into the new year.

A Brussels judge will still have to decide whether to follow Spain's request to extradite Lluís Puig, another Catalan pro-independence politician, but who was not elected as MEP. A decision is expected in February.
